1. Definitions

  • App — DigiStamp, a digital loyalty-card platform.
  • Business owner — a user holding a business account.
  • End customer — a person using a loyalty card issued by a business owner.

2. Acceptance

By creating a business account you confirm you have read and accept these Terms and the Privacy Policy.

3. Service scope

The app enables business owners to run a digital loyalty program (stamps, rewards, statistics, customer panel).

4. Accounts & subscriptions

  • Starter: 14-day free trial + £20/month, up to 50 customers.
  • Unlimited: £35/month, unlimited customers.
  • Payments handled by Stripe (once integrated). Invoices available in the panel.
  • Cancellation: any time, effective at end of billing cycle.

5. Business-owner obligations

  • The business owner is the data controller for their end customers and accepts the Data Processing Agreement (/legal/dpa).
  • Collects end-customer consents in line with UK GDPR / PECR at their premises.
  • Does not use the app for unlawful purposes.

6. Limitation of liability

REQUIRES LEGAL REVIEW ⚠️ — proposed scope:

  • The app is provided "as is" without guarantee of uninterrupted availability.
  • Liability capped at the fees paid in the preceding 12 months.
  • Excluded: indirect damages, loss of profits, loss of customers.
  • This clause does not exclude liability which cannot be excluded under UK law (death, personal injury, fraud).

7. Termination

  • The owner may delete their account any time: Settings → "Delete account".
  • DigiStamp may terminate with 30 days' notice.
  • Immediate termination for material breach.

9. Governing law

Governed by the laws of England and Wales. Disputes resolved by English courts.

10. Changes

Changes take effect 14 days after notification. Continued use = acceptance.

11. Intellectual Property and System Protection

11.1. Intellectual property and licence

All rights to the App name (DigiStamp), its internet domain, graphic elements, user-interface layout (GUI) and databases belong exclusively to the Service Provider — Izabela Banachiewicz, sole trader operating in the United Kingdom. The User is granted only a non-exclusive, non-transferable and time-limited licence to use the App in accordance with its intended purpose.

11.2. Prohibition of reverse engineering

Copying, modifying, reproducing, decompiling or attempting to reconstruct the source code, architecture and operating mechanisms of the App by the User or by third parties is prohibited.

11.3. Reservation to change the stamp system

The Service Provider reserves the right to change the DigiStamp conversion rate, the list of rewards and to terminate the loyalty programme subject to a 30-day notice period, of which Users will be informed inside the App or by email. Changes to the rules do not apply retroactively to DigiStamps already collected by customers before the effective date of the change — collected DigiStamps remain valid on the previous terms until they are used or until the transition period stated in the notice ends.
